GDPR Morning: what’s the assessment a year after it entered into force?

A year after implementation of the GDPR (General Data Protection Regulation) regulation, it is time for an initial assessment. The CNIL (French Data Protection Authority), which assists actors and monitors proper application of the GDPR and the French Data Protection Act, has issued its first recommendations, but also its first sanctions decisions.
What conclusions can we draw from them? What were the first sanctions pronounced? What was the justification for the nature of the sanctions and the amounts of fines determined by the supervisory authority? The Simmons&Simmons team will provide us with its insight on the first months of the GDPR’s implementation and will share with us its feedback on the best practices to adopt and the pitfalls to be avoided.
We will also examine the GDPR’s impact in the work environment, notably with respect to new recruitment techniques and the development of remote work. Lastly, there will a specific focus on the issue of data security and management and notification of security breaches.
At that time, Laurent Charvériat, General Manager of ITracing, will provide an analysis of the processes to be implemented to prevent cyberattacks and to manage the consequences of IT system failures.

International Sanctions

You have surely noticed that there are many current events related to international economic sanctions. To debate this subject that is very relevant for many French (and European) companies, Le Cercle De la Compliance is organizing a new meeting of its International Sanctions workshop on January 31. This time, it will be about examining the practical aspects of complying with international sanctions, including American sanctions, with a case study that will be presented by George Voloshin, the manager France of the investigations firm Aperio Intelligence. Among the issues addressed: How to carry out due diligence on third parties within the framework of sanctions? Why is the shareholder structure important? And final beneficiaries? “Specially designated national” versus sector sanctions: what impact do they have? How to prepare for the potential new sanctions in 2019? We will have a meeting with our members on January 31, 2019, beginning at 5:30 p.m.

The Sapin II Act was adopted on ______. Since then, the AFA has issued recommendations and published its questionnaire for preparing companies for a possible audit. Many audits have already taken place that have led to reports by the AFA. Cartography, management of third parties, codes of conduct, alerts, investigations, training, audits: Le Cercle de la Compliance’s workshops have provided to opportunity to discuss a large number of issues.
Today, the firm August & Debouzy proposes an overview of this act, obligations for our companies and their interpretations, with 18 months of hindsight and feedback. This training course is broken down into three sessions:
